Epic Life Shots LLC - Terms and Conditions

Welcome to Epic Life Shots LLC! By creating an account, accessing our galleries, or using our services, you agree to the following Terms and Conditions. Please read these terms carefully, as they form a legally binding agreement between you ("the Client") and Epic Life Shots LLC ("the Company"). If you do not agree, you may not create an account or access our services.

1. Agreement to Terms

1.1. By creating an account, accessing galleries, or placing orders, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
1.2. These Terms apply to all users of Epic Life Shots LLC services, including schools, parents, students, and other gallery users.

2. Privacy and Data Usage

2.1. Information Collection:

• We collect personal information such as your name, email address, phone number, and mailing address to process bookings, provide access to online galleries, and fulfill orders.
• Payment information is processed securely through third-party payment processors (e.g., Stripe). Epic Life Shots LLC does not store credit card information.

2.2. How Your Information Is Used:

• To facilitate your access to galleries and deliver purchased products.
• To communicate with you about your account, orders, and services.
• To comply with legal and regulatory requirements.

2.3. Data Security:
We use industry-standard measures to protect your personal information from unauthorized access or disclosure. However, we cannot guarantee absolute security, and you agree to provide information at your own risk.

2.4. Data Sharing:
Your data will not be sold or shared with third parties, except:

• With payment processors to process transactions.
• With printing labs and shipping providers to fulfill orders.
• As required by law or to comply with legal obligations.

3. Account Registration

3.1. You must create an account to access your gallery and place orders. You agree to provide accurate, current, and complete information during registration.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Gallery Access

4.1. Access to online galleries is provided solely for viewing, ordering, and downloading photographs taken by Epic Life Shots LLC.
4.2. Access is granted only to the intended recipient(s) (e.g., families, students, or schools). Sharing login credentials or gallery links with unauthorized individuals is prohibited.

5. Image Usage Rights

5.1. All images are the intellectual property of Epic Life Shots LLC and are protected by copyright laws.
5.2. Digital files purchased through the galleries are licensed for personal, non-commercial use only.
5.3. You may not edit, modify, reproduce, distribute, resell, or use the images for commercial purposes without the prior written consent of Epic Life Shots LLC.
5.4. Proof images are for viewing purposes only and may not be downloaded, shared, or reproduced.

6. Orders and Payment

6.1. Placing Orders:

• All orders for digital or physical products are final and non-refundable.
• You are responsible for verifying the accuracy of your order, including image selection and delivery details, before submitting payment.

6.2. Payment Processing:

• Payments are securely processed through third-party providers (e.g., Stripe). Epic Life Shots LLC does not store or manage credit card information.

6.3. Delivery:

• Digital files are delivered electronically at no additional cost.
• Physical products incur shipping fees, which are calculated during checkout.

7. Proof Galleries

7.1. Proof images are previews and are not final, edited images. Slight variations in colors, poses, or backgrounds may occur between proofs and final products.
7.2. Backgrounds and themes displayed in proof images are illustrative and do not imply endorsements or values by Epic Life Shots LLC.

8. Refunds and Replacements

8.1. Digital products are non-refundable once delivered.
8.2. If a product arrives damaged or with a verified error on the part of Epic Life Shots LLC, a replacement of the same product will be provided at no additional cost.
8.3. Refund or replacement claims for physical products must be submitted within 7 days of receipt and include photographic evidence of the issue.

9. Gallery Availability

9.1. Online galleries remain active for 60 days from their launch date. After this period, galleries may be archived or deleted without prior notice.
9.2. Reactivation of archived galleries may incur a reactivation fee.

10. Cancellation and Rescheduling Policies

10.1. School Picture Day:

• No deposit is required. Rescheduling is allowed with at least 48 hours’ notice, subject to photographer availability.

10.2. Private or Corporate Sessions:

• A 25% or $200 non-refundable deposit (whichever is greater) is required to secure your booking.
• Cancellations made with at least 21 days’ notice are eligible for a deposit refund.

10.3. Late Arrivals and No-Shows:

• If you are more than 15 minutes late, the session may be shortened or rescheduled at the photographer’s discretion.
• Failure to attend without notice will result in forfeiture of the deposit, and you may be charged 50% of the remaining balance.

11. Health and Safety Acknowledgment

11.1. Epic Life Shots LLC adheres to health and safety guidelines during all sessions.
11.2. Clients must notify Epic Life Shots LLC if any participant is unwell or has been exposed to a contagious illness before the session.

12. Limitation of Liability

12.1. Epic Life Shots LLC’s liability for any claim is limited to the amount paid for the service or product in question.
12.2. We are not liable for incidental or consequential damages, including but not limited to loss of data, loss of profits, or business interruptions.

13. Force Majeure

13.1. Epic Life Shots LLC is not responsible for delays or cancellations caused by events beyond our control, including but not limited to natural disasters, technical failures, or government restrictions.
13.2. In such cases, we will work with affected clients to reschedule services or issue refunds if appropriate.

14. Disputes and Chargebacks

14.1. Customers must contact Epic Life Shots LLC directly to resolve any disputes before initiating a chargeback or credit card dispute.
14.2. Filing a chargeback without prior communication may result in loss of eligibility for future services.

15. Changes to Terms and Conditions

15.1. Epic Life Shots LLC reserves the right to update or modify these Terms and Conditions at any time.
15.2. Changes will be posted on this page, and continued use of our services after updates constitutes acceptance of the revised terms.
