Epic Life Shots LLC - Order Placement Terms and Conditions
Effective Date: January 19, 2025
By placing an order through Epic Life Shots LLC's online galleries, you ("the Client") agree to the following Terms and Conditions. These terms govern the purchase of both digital and physical products. Please read them carefully before completing your order.
1. Agreement to Terms
1.1. By placing an order, you confirm that you have read, understood, and agree to these Terms and Conditions.
1.2. These Terms apply to all orders placed through Epic Life Shots LLC's online galleries and are binding once an order is submitted.
2. Product Types and Delivery
2.1. Digital Products
2.1.1. Purchased digital images are delivered as high-resolution files for personal use only.
2.1.2. After your order is placed, necessary edits will be completed, and your digital images will be re-uploaded to your gallery for download within up to 5 business days.
2.1.3. You will be notified via email when your digital files are available for download.
2.2. Physical Products
2.2.1. Physical products, such as prints, are prepared and shipped to the address provided at checkout. Delivery times typically range from 7 to 14 business days from the time the order is placed.
2.2.2. Shipping fees apply to all physical orders and are calculated at checkout. Expedited shipping is not available at this time.
2.2.3. You are responsible for providing an accurate shipping address during the checkout process. Epic Life Shots LLC is not responsible for delays or nondelivery caused by incorrect or incomplete addresses provided by the Client.
3. Restrictions on Image Use
3.1. Purchased digital images are licensed for personal use only.
3.2. Clients may not edit, modify, reproduce, distribute, resell, or use purchased images for any commercial purposes without prior written consent from Epic Life Shots LLC.
3.3. Proof images or any images not purchased are strictly prohibited from being downloaded, shared, or used in any form. Unauthorized use of proofs or unpurchased images may result in legal action.
3.4. All images remain the intellectual property of Epic Life Shots LLC and are protected by copyright laws.
4. Refunds, Replacements, and Damages
4.1. Refund Policy
4.1.1. Digital Products: All sales of digital images are final. Refunds are not available for digital products because clients are able to view and select the exact images they wish to purchase prior to placing their order. Additionally, once an order is placed, it immediately enters processing, including necessary edits, and cannot be canceled or refunded.
4.1.2. Physical Products: Refunds are not available for physical products for the same reason: clients select the exact images for their order at the time of purchase.
4.2. Replacements for Damaged or Incorrect Products
4.2.1. If a physical product is received damaged or contains errors caused by Epic Life Shots LLC, it will be replaced at no additional cost.
4.2.2. Claims for replacement must be submitted within 4 days of receiving the product. To file a claim, email help.epiclifeshots@gmail.com with:
A description of the issue.
Photographic evidence of the damage or error.
4.2.3. Upon verification, Epic Life Shots LLC will replace the product. Replacement is limited to the same product originally ordered.
4.2.4. Epic Life Shots LLC is not responsible for damages caused by third-party shipping carriers once the product is delivered.
5. Order Modifications and Cancellations
5.1. Order Modifications:
Modifications may be allowed if the request is made before the order enters processing.
Requests for modifications must be submitted by contacting Epic Life Shots LLC directly via email or phone.
Epic Life Shots LLC will confirm whether modification is possible. If approved, additional fees may apply depending on the changes requested.
5.2. Order Cancellations:
Orders for digital products cannot be canceled once they are placed, as work begins immediately.
Orders for physical products may be canceled before processing begins, subject to approval by Epic Life Shots LLC.
5.3. Epic Life Shots LLC reserves the right to decline modification or cancellation requests at its discretion, particularly if the order has already entered processing or production.
6. Editing and Customization
6.1. All purchased digital images include basic editing (e.g., color correction, exposure adjustments).
6.2. Additional editing or customization requests (e.g., advanced retouching, removal of objects, background changes) are available for an additional fee, which is listed in your gallery.
6.3. Advanced editing requests must be specified and paid for at the time of order placement. Late requests may not be accommodated.
7. Gallery Access and Duration
7.1. Online galleries remain accessible for 60 days from the date they are made available to the Client. After this period, galleries may be archived or deleted without prior notice.
7.2. Reactivation of archived galleries may incur an administrative fee.
7.3. It is the Client's responsibility to download digital products before the gallery expires. Epic Life Shots LLC is not liable for expired or inaccessible galleries.
8. Force Majeure
8.1. Epic Life Shots LLC is not responsible for delays or cancellations caused by events beyond its control, including but not limited to natural disasters, technical failures, labor disputes, pandemics, or government restrictions.
8.2. In such cases, Epic Life Shots LLC will work with the Client to resolve the issue and may provide alternative solutions, such as rescheduling services or issuing a replacement product.
9. Limitation of Liability
9.1. Epic Life Shots LLC’s liability for any claim related to an order is limited to the amount paid by the Client for the affected product(s).
9.2. Epic Life Shots LLC is not liable for:
Incidental or consequential damages, including but not limited to loss of data, lost profits, or business interruptions.
Dissatisfaction with poses, expressions, or settings chosen by the Client.
Errors caused by third-party shipping carriers.
10. Governing Law
10.1. These Terms and Conditions are governed by the laws of the State of New York.
10.2. Any disputes arising from or related to these Terms shall be resolved exclusively in the courts of New York.
